Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of www.britrockheaven.com (the "Site") operated by BritRockHeaven ("BRH", "we", "us"). By using the Site, creating an account, or purchasing any paid service, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

2. Eligibility & accounts

You must be at least 13 years old to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that breach these Terms, are inactive for a prolonged period, or are used to harm the Site or other users.

3. Track submissions

BRH accepts free track submissions, with an optional £5 priority submission processed via Stripe. By submitting a track you confirm that:

• You own or control all rights in the track (composition, recording, artwork) or have permission to submit it.
• You grant BRH a non-exclusive, royalty-free licence to listen, review, quote, embed, and reference the track on the Site and our social channels in connection with editorial coverage.
• The £5 priority fee guarantees that your submission moves to the front of the review queue and receives a written response — it does not guarantee publication or a positive review.
• Editorial opinion, ratings and critical commentary are independent and will not be altered to favour the submitter.

4. Media packages

Media packages (currently £10, £30 and £90) pay for guaranteed editorial coverage produced by the BRH editorial team, with deliverables described on the Media Packages page at the time of purchase. They do not buy endorsement, a positive review, promotional messaging or sign-off rights over the finished piece. By purchasing a package you agree to:

• Provide the requested assets (audio, artwork, biography, links) in a timely manner.
• Warrant that you own or control all rights in those assets.
• Accept that the angle, length and tone of the resulting piece are editorial decisions, and that BRH may disclose the paid relationship to readers (for example with a note such as "Published as part of a BRH media package").

Delivery timeframes are estimates. If we are unable to deliver a package, we will issue a full refund under Section 6.

5. Payments

All payments are processed by Stripe. Prices are in GBP and include VAT where applicable. We do not store full card details. You are responsible for any bank or currency conversion fees charged by your provider. By paying, you authorise the charge and confirm you are the legitimate holder of the payment method used.

6. Refunds & cancellation

Under the UK Consumer Contracts Regulations 2013, digital services that have already started with your consent are not generally subject to the 14-day cancellation right. By submitting a track or purchasing a media package you expressly consent to immediate performance and acknowledge you lose that right.

Outside of that, we will issue a full refund if: (a) we are unable to fulfil a "guaranteed coverage" submission or media package within a reasonable timeframe; (b) the service is materially not as described; or (c) we cancel the service for reasons outside your control. Requests should be sent to contact@britrockheaven.com within 30 days of purchase.

7. User-generated content

The Site allows registered users to post comments, participate in discussions, vote in polls, and create a public profile. You retain ownership of content you post but grant BRH a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, adapt and distribute it in connection with operating and promoting the Site.

You are solely responsible for what you post. We may edit, hide or remove any user content, and suspend or terminate accounts, at our discretion and without notice — particularly where content breaches Section 8.

8. Prohibited content & conduct

You must not post, submit, or transmit any content that:

• Is unlawful, defamatory, harassing, threatening, hateful, or discriminatory on the basis of race, ethnicity, religion, gender, sexuality, disability or any other protected characteristic.
• Infringes any copyright, trademark, moral right, privacy right or other intellectual property right.
• Is sexually explicit, contains nudity, or is harmful to minors.
• Promotes violence, self-harm, terrorism, or illegal activity.
• Contains spam, scams, phishing, malware, or unsolicited advertising.
• Impersonates another person, brand, or artist, or misrepresents your affiliation.
• Interferes with the security or operation of the Site, including scraping, automated abuse, or attempting to bypass authentication, rate limits or anti-spam measures.
• Uses AI-generated audio or artwork submitted as the work of a real artist without disclosure.

We co-operate with law enforcement and rights holders where required and may disclose user information in response to valid legal process.

9. Copyright & takedown

If you believe content on the Site infringes your copyright, email contact@britrockheaven.com with: (i) the URL of the content, (ii) a description of the work, (iii) proof of ownership, (iv) your contact details, and (v) a statement made in good faith. We will review and act on valid notices promptly.

10. Intellectual property

All editorial content, branding, design, code and compilation on the Site is owned by BRH or its licensors and is protected by UK and international IP law. You may share links and short quotations with attribution, but you may not republish, scrape, or use our content for AI training without prior written permission.

11. Third-party services & advertising

The Site uses third-party services (including Supabase, Stripe, FormSubmit, Spotify embeds, and Google AdSense). We are not responsible for the content, policies or practices of third-party sites linked from or embedded within the Site. Ads served by Google may use cookies subject to your consent — see our Privacy Policy.

12. Disclaimers & liability

The Site is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or secure.

Nothing in these Terms limits liability that cannot be excluded under English law (including for death, personal injury caused by negligence, or fraud). Subject to that, to the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Site or any paid service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.

We are not liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, data, or goodwill.

13. Termination

You may stop using the Site or delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms or if we reasonably believe your activity may harm BRH, other users, or third parties. Sections that by their nature should survive termination (including Sections 7, 8, 10, 12 and 14) will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page, and where appropriate by a notice on the Site. Continued use of the Site after changes take effect constitutes acceptance.
