1. Our position on copyright
BritRockHeaven ("BRH") respects the intellectual property rights of artists, photographers, labels and writers. We respond to credible notices of copyright infringement under the US Digital Millennium Copyright Act (DMCA) and equivalent UK / EU copyright law (including the Copyright, Designs and Patents Act 1988).
Editorial use of short quotes, low-resolution artwork or press images for the purpose of criticism, review and news reporting is made in reliance on fair dealing / fair use. If you believe a specific use on BRH goes beyond that, please contact us using the process below and we will review promptly.
2. How to send a takedown notice
Send written notice by email to contact@britrockheaven.com with the subject line "DMCA / Copyright Takedown". To be actionable, your notice must include all of the following:
- Your full legal name, postal address, telephone number and email.
- Identification of the copyrighted work you claim has been infringed (title, author, and a link or copy of the original where possible).
- The exact URL(s) on britrockheaven.com of the material you want removed or disabled, and a description of what part of each page is infringing (image, quote, audio, video, etc.).
- A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on their behalf.
- Your physical or electronic signature.
Incomplete or clearly abusive notices may be ignored. Sending a knowingly false takedown notice may make you liable for damages, including legal costs, under the DMCA and equivalent UK law.
3. What happens next
- We aim to acknowledge valid notices within 5 working days.
- Where the complaint appears valid, we will remove or disable access to the material and notify the user or contributor who posted it.
- Where the complaint is unclear, we may ask for more information before acting.
- We keep a record of takedown notices and our response to support our repeat-infringer policy.
4. Counter-notice
If you believe your content was removed in error or as a result of misidentification, you may submit a counter-notice to contact@britrockheaven.com. A valid counter-notice must include:
- Your full name, postal address, telephone number and email.
- Identification of the material that was removed and the URL where it appeared.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your consent to the jurisdiction of the courts of England and Wales (or, if outside the UK, the federal court for the judicial district in which you reside), and that you will accept service of process from the original complainant.
- Your physical or electronic signature.
If we receive a valid counter-notice, we may forward it to the original complainant. We may restore the material after a reasonable period unless the complainant notifies us that they have filed legal proceedings.
5. Repeat-infringer policy
Accounts (including contributor accounts and registered readers) that are the subject of repeated, credible copyright complaints may have their content removed, their submission privileges revoked, or their account terminated. Decisions are at the editor's discretion and are taken with proportionality in mind.
6. Third-party platforms
BRH content is sometimes embedded from, or republished to, third-party platforms (for example Spotify, YouTube, Instagram, X). Copyright complaints relating to material hosted on those platforms should be sent to the platform directly using their own takedown procedure. We are happy to remove the embed from BRH in parallel.
7. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top of this page reflects the latest revision.
